1. WHO YOU'RE DEALING WITH

This store is operated by Supernova Forestry Services Ltd. ("Supernova", "I", "me", "my").

By using this store or placing an order, you agree to these terms.

2. ELIGIBILITY

You must be the age of majority in your province or territory to order from this store.

3. PRODUCTS

I'm an authorized dealer for Ten4Tec products. I buy at wholesale, hold my own inventory, and ship from West Kelowna, BC. I'm not the manufacturer.

I try to show products accurately, but colours can look different on different screens, and packaging and product details can change without notice from the manufacturer. If a product you receive is materially different from what was described, that's covered by the Refund Policy.

4. PRICES AND PAYMENT

All prices are in Canadian dollars (CAD).

GST of 5% is added to all orders. BC PST is not currently charged.

Prices can change at any time before you place an order. The price you paid at checkout is the price that applies to your order.

I reserve the right to refuse or cancel any order — including for suspected fraud, a pricing error, or stock that turns out to be unavailable. If I cancel an order you've already paid for, you get a full refund.

5. ORDERS AND STOCK

Placing an order is an offer to buy. Your order is accepted when I ship it.

I hold limited stock. If something sells out between your order and my packing bench, I'll email you and refund you in full, or hold the order until it's back in — your choice.

6. PRODUCT USE — READ THIS

The products sold on this store are carry equipment. They are designed to hold a two-way radio.

They are not personal protective equipment. They are not fall protection. They are not life safety equipment, rescue equipment, climbing equipment, or a positioning device. They are not designed, rated, tested, or sold to arrest a fall, support a person's weight, or protect anyone from injury.

Do not use these products for any load-bearing, fall protection, climbing, positioning, rescue, or life safety purpose. Do not attach them to any anchor, lanyard, rope, lifeline, or other fall protection or climbing system. Doing so could cause serious injury or death.

Nothing sold on this store replaces the personal protective equipment your employer, your prime contractor, your site, or applicable occupational health and safety regulations require you to wear. You remain responsible for wearing the correct PPE for your work.

Use of any product from this store is entirely at your own risk. It's your responsibility to inspect equipment before use, to use it as intended by the manufacturer, and to remove it from service if it's damaged or worn.

7. WARRANTY

Apart from any manufacturer's warranty that may apply, products are sold as-is. Nothing in these terms removes or limits any rights you have under applicable consumer protection legislation that cannot be excluded by agreement.

If a product fails and it appears to be a manufacturing fault rather than wear, contact me and I'll take it up with the manufacturer on your behalf.

8. LIMITATION OF LIABILITY

To the fullest extent permitted by law, Supernova's total liability arising out of or relating to any product or order is limited to the amount you paid for that order.

To the fullest extent permitted by law, Supernova is not liable for indirect, incidental, special, consequential, or punitive damages, including lost profits, lost income, or loss of use, arising out of or relating to any product, order, or use of this store.

Some jurisdictions don't allow certain limitations of liability. Where that's the case, these limits apply only to the extent the law permits, and nothing here affects rights that can't be excluded by agreement.

9. SHIPPING, RETURNS, AND PRIVACY

The Shipping Policy, Refund Policy, and Privacy Policy form part of these terms.

10. YOUR ACCOUNT

If you create an account, you're responsible for keeping your login details secure and for anything that happens under your account. Tell me right away if you think someone else has access to it.

11. ACCEPTABLE USE

Don't use this store to do anything unlawful. Don't attempt to interfere with the site, scrape it, or gain unauthorized access to any part of it. Don't submit false information or place fraudulent orders.

12. CONTENT ON THIS STORE

The text, photos, and video on this store are mine, except for manufacturer materials used with permission. Don't copy or republish them without asking.

If you send me a photo or video of your gear and I ask to share it, I'll ask first.

13. THIRD-PARTY LINKS AND PLATFORMS

This store links to and interacts with third-party services, including Shopify, payment processors, shipping carriers, Instagram, Facebook, and ManyChat. I'm not responsible for their content, terms, or privacy practices.

14. CHANGES TO THESE TERMS

I can update these terms at any time. The version posted here when you place an order is the version that applies to that order.

15. GOVERNING LAW

These terms are governed by the laws of the Province of Alberta and the federal laws of Canada that apply there. The courts of Alberta have jurisdiction over any dispute, and you consent to that jurisdiction.

If you're a consumer resident in another province, this doesn't take away any rights you have under the consumer protection laws of the place you live that can't be contracted out of.

16. SEVERABILITY

If any part of these terms is found unenforceable, the rest still applies.
